Justin Nelson, a close friend of Sheriff Arpaio,

pursuant to the old saying "a lawyer who represents himself has a fool for a client", Nelson has been counseled by Anthony Tsontakis, Esq. concerning material herein.

The most significant surprise in this lawyer tale is that Justin Nelson is not a liar lawyer at all even though the Phoenix School of Law supports his statements of a J.D. degree from that entity.

Tsontakis is a graduate and has endeavored to assist Nelson in the unauthorized practice of law and defraud $8000 from "clients" for Nelson's legal services.

Below are some email conversations between Nelson and some business persons in the phoenix area he chose to harass and defraud.

Subject: Making Me Popular

Wow buddy, you are making me a popular cat here in Arizona. From the feds, to the State, County, and numerous city PD, and their City Attorney's offices have been blowing up my phone wanting to get their hands on the portable hard-drive that contains the files from you. First I thought about letting it go to the highest bidder, but I've decided just to give it to all of them and let them transfer to their computers. Now you've tied up my schedule for the next two days with meetings to bring this damn file dump all over the valley. Should be charging you for gas....

On the plus side, what started out to be a shitty delusional book that would have never sold, now has the potential to be a bestseller once Arizona finishes with you; sold and featured of course, at scotthuminski.com. (Unless someone purchases it first).

By the way, I see that Judge Daniel Dodge (Adjunct Professor Dodge - 2L - Civil Procedure II ) is the presiding judge in your suit in Highland justice court against the City of Surprise. If I don't have a chance to talk to him before you get into court, tell him hello for me....

After a small amount of consideration, I have decided that where there is no harm, there is no foul. So I'm not going to waste any time on you. But keep in mind that between ASU and PSL I graduated with more than 100 "practicing" lawyers that are scurrying all over the Valley right now doing every type of law imaginable. The two book ideas are being written, starting with the takeover of the US one (which should have been written 5 years ago). I have attempted contact with you, and gave you full opportunity to have input in what were originally our joint story ideas. But your failure to want to communicate, your failure to acknowledge the stories, and your frivolous complaints with the State Bar of Arizona (which are absolutely laughable by the way), cannot be construed as anything other than a waiver of any and all rights to participation and/or compensation in any publication that in any way resembles the story lines originally created jointly years ago.

Don't like these terms, better get a good lawyer. I have lots of them...

You can hate me, but it is what it is..and it might even make things more productive business wise. Profit here is the word of the day. For your concern, my ABA# is 01518802, and I am federally barred, so I can add whatever I want to the end of my name whether I take the bar in Arizona or not.

Now you're talking about how you've moved onto another way of doing things because my way was "toxic." How would you know what my way of doing things is after 10 years. My son is a straight A student and the quarterback at his school, and Mariah just left for Utah University on scholarship to become a high school teacher. I must be doing a few things right.

Bottom line is, you don't even know me anymore, but as for you, you are exactly the same as I remember. But now I'm the one who's published, who has a syndicator (creators syndicate) and a literary agent, and I'm the one who will make one if not both of those story lines a reality in print.

I could certainly use your help in the storylines, but I was contacting you much more as a favor to you than it will ever be to me. The stories are going to get written, published, and paid with or without you. Just thought now that your pushing over 50, you may have actually wanted to accomplish one of the real dreams that you once had in life. Now that I'm in a position to actually help fulfill it, I thought maybe enough time had gone by to bring some sense to your mind....

Hello Justin,

Thank you for your email. I'm glad to hear that you completed law school and are doing well.

Yes, it has been a while. I have been extremely busy with my property management business and we currently manage over 1,100 properties in the Metro Phoenix area and that number grows by 20 - 50 new properties per month. We just hired our 21st employee and, by year's end, will have annual gross revenues exceeding $2.5 million in just 4 short years starting from zero. I had to become a licensed real estate agent, due to Department of Real Estate guidelines, and have just begun classes to obtain my Broker's license. People constantly tell me that I should go to law school because of how much I enjoy the details of real estate law and I'm known as the "go to" person for answers as it pertains to property management law and the Arizona Landlord Tenant Act. Of course, we are staying busy with the kids as they are both on competitive soccer leagues that require two practices each during the week (On different days), and then soccer games at different times and locations for each on the weekends. Never enough time!

I understand that you may be frustrated with my lack of follow through regarding your past attempts to contact me, but honestly, it was more by design. Although we spent quite a bit of time together during school, I was not happy with some of your behaviors. I blame some of that on the pot you constantly smoked, some on not having a job to keep you busy, and some just as how you were as a person - not that you were a horrible person, but your demeanor became obnoxious and toxic to me after a while. I discovered myself becoming more callous and uncaring as a person and down-right mean at times. My personality began to mirror yours to the point that I didn't like who I was. To be clear, I'm not blaming you, but I had to separate myself from that behavior in order for me to get back to who I used to be. It's hard to believe that only a short period of time hanging around someone can do that, but I was a weaker person back then (With my job losses, personal challenges, etc.) and not really knowing what I wanted to do at 39 years old, even with all my past business experiences.

I have always thought of you as being a brilliant mind, but unfortunately your pot smoking and dissimilar priority schedule of life pushed me to a different level. I'm glad of the experiences that we had in school, but I'm on to my own things now. In addition, I had discovered some other untruths (From reliable sources close to you) with regards to you "owning" the sub shop, property ownership, and some other events that further pushed me back from wanting to sustain contact with you. As you stated in your earlier email, it's not that you did anything that badly, but just different enough for me to go in another direction and one with which I'm very happy with. I don't want to sound cacophonous with this response nor wish to exacerbate any tension, but I merely wanted to share my insight with you as to why I wish not to revive the relationship, even for business sake.

I really do wish you the most success you can achieve in life. One never knows how short life can actually be. Just ask Steve Jobs.

Sincerely,

P.S. I'm not sure that you can legally place Esq. at the end of your name if you haven't passed the bar exam and are not a member of the Arizona Bar Association. You may wish to check into that. Below is some info that I found:

CHSLAW is correct. Esq. is listed after the name of a practicing attorney to signify that he or she is a member in good standing of the bar in at least one jurisdiction.

A law school graduate is entitled to use J.D. (juris doctor) after his or her name, but cannot hold him- or herself -out as an attorney (by using Esq.) unless he or she has passed a bar exam and been sworn in. Esq. implies that the user is a member of the bar.

One final thought I forgot to discuss. I have been thinking a lot about writing the books for both stories that we came up with together, about the "division of the US" and the "G.O.D. concept." I have not yet published a novel under my own name, although I have written and published three now as a ghostwriter (all legal, non-fiction based). All were at least 300 pages long. I have however, published, christ I have no idea how many articles, and I am syndicated through Creator's Syndicate for my work on politics and law. Finding a literary agent for me now would be like picking from a menu, so I'm quite sure I could get one or both of these books on shelves with some serious marketing exposure.

The problem is, I cannot write them without you. I am a fact writer and a scenario builder, but I still have no "fluff." And I simply cannot trust anybody else, even after all this time, like I trust you to be involved in these two story lines. As my legal and writing career has grown and flourished, they have remained in my mind nearly constantly. I can write these, I can get them picked up, and I can get them published. But I can't do it alone. And I can't think of anything I did bad enough to you in some way to turn down a potential business deal that requires limited input on your part, or at least a declination to participate.

One drink and conversation for old times, and possibly new.... All I'm asking for. Please email me or give me a call. It would mean a lot.

Hello ,

It has been a long time, and I understand that. I have tried to contact you numerous times, after MBA, after law school, after publications, after finding you on Linking-in, and also on FB. You have simply ignored all of my requests...

I guess my question to you is why? I made some big mistakes I'm sure, but I was always very fond of you, Trevor still remembers you at 13 years old, and people change from some of the things that they do. After all of this time, I would like to know why all of my attempts to reconnect with you have been shunned.

At least if I could have that answer I could have some closure for what actually took place to what was a good friendship those years ago.

Hope to Hear From You

Justin Michael Nelson has been spotted several times in or around the Lakes at Annecy community in Gilbert (the Huminskis home) since the County Attorney's decision in CA2011044662.  At one time with a fabric wrapped item that could have concealed an assault rifle.  Its probable the City Attorney in Surprise who tipped off Nelson just as they tipped him off to the involuntary mental health exam.  He is probably infuriated that the felonies were forwarded to prosecution and hell bent on seeking revenge and empowered his stated belief he would get a citizens achievement award for murders -- confirmed by the reward he received from the county attorney.  Revenge is the theme of his life.  It is believed that Nelson has chosen Christmas for his revenge murders and posters will be distributed to the community prior to Christmas to call 911 if Nelson is spotted.

It is obvious that Nelson has not used the courts for redress, that is a sham.  He has carried through with his threat in filing a patently false petition against me for a mental health pickup.  He also has enlisted the Phoenix Police to harass me concerning the 100% truthful petition I filed with mental health authorities about his murder and violence emails.  Now he is in the next phase, murder.  Note his multiple references to "revenge is a dish best served cold" and going to lawschool to "exact revenge".

Nelson follows through with his illegal threats, the threat of court actions are illusions as he admitted he was the one who caused civil issues in the taped conversation with scott stewart.  The entire matter was a fraud assisted by criminal impersonation of an attorney. As to his mafia-style threats of sending a collector over, he may have ties to organized crime.

I have weapons here, but, nothing that can fend off an assault rifle.  -- scott huminski

Scott Huminski,

As a result of your failure to communicate regarding the contract dispute, I have been prevented from my willing specific performance under the terms of the contract. Consequently, this is notification that you have committed an additional breach under the terms of the contract.

For the foregoing reasons, this project is now complete.

"The doctrine of "substantial performance" saves a party who has largely fulfilled his obligations under a contract from suffering major loss merely because he has unintentionally fallen short in some particular which does not affect the essence of the contract. There has to be a limit to the quibbles of the dissatisfied customer or the courts would be swamped with trials over precise shades of paint and tiny imperfections in services. A party can unintentionally fall short of perfection, but if he has substantially performed his duties under the contract, he can still sue the other party for payment.”

As a result of my "substantial performance," under the terms of the contract, I am including an invoice in the amount of $2000, payable immediately and upon receipt of this notification.

This simply is not just going to go away now Scott. I have always been a firm believer that revenge is a dish best served cold. Since you're not man enough to deal with your breach and fix your own mistakes, which is comical because your so quick to hold everyone else accountable for theirs; you better find yourself a good lawyer, one I'm not friends with. I will see to it, within the scope of the law, that your book never gets into the public view without your performance under the contract.

This is one last opportunity for you to remedy the breach, or the next time you hear from me will be through a process server. Call me today.

The Sheriff's own close friend and crony confirms the corruption in the MCSO & County Attorneys office.  The sheriff looking the other way concerning death threats from his crony speaks for itself.

Arpaio now has the county attorney running errands, filings extensive paperwork in a lawsuit that was never served upon Arpaio.  Misuse of county funds and resources.

Not surprising that Arpaio is the most well known sheriff in the country, look at death threats he advocates by looking the other way while at the same time he targets people that are not involved in crimes of violence.

RE:     Federal Email Threat Legislation needed in Wake of Tucson Representative        Gabrielle Giffords Shootings and Murders.  AZ inviting more shootings/murders.

Dear Senators and Representatives,

I write this letter with a heavy heart knowing that the terrible shootings and murders that took place in Tucson this year are destined to repeat without proper legislation.

Months after the Tucson tragedy email threats of violence and death were sent to myself and my wife.  Law enforcement in the Town of Gilbert, Arizona and the City of Surprise, Arizona classified the emails as acceptable, lawful and proper.

A State authorized mental health provider, Urgent Psychiatric Care of Phoenix, Arizona, found the emails represented imminent probability of harm to the targets of the emails and issued a police pickup order for an involuntary mental evaluation of the author of the emails, Justin Michael Nelson.

Egregiously, the City of Surprise, Arizona refused to pick up Mr. Nelson for several (4) days until they were forced to attempt pickup of Mr. Nelson.  At that point they made what was described as half-hearted "pseudo-attempts" to pickup Mr. Nelson while high ranking City Attorneys in Surprise tipped off Mr. Nelson to the fact that the police were on their way.

The emails sent by Mr. Nelson originated in Surprise, AZ and were processed and forwarded to the Huminskis by Gmail (google email) of California.  The emails may have traveled through other states as well.  The federal government has jurisdiction over this type of interstate crime.  Gilbert Police have confirmed the emails via results of a subpoena served upon google.  Some emails investigated by Gilbert Police violated a Court ordered restraining order against Nelson concerning the Huminskis, a felony in Arizona.  Again Gilbert Police with undisputed and overwhelming probable cause for an arrest ignored the criminal terrorizing of the Huminskis.

There is an audio tape of Mr. Nelson admitting to the emails in a telephone conversation with an attorney (transcript and audio available).  The death and violence emails (Dana is my wife) are as follows:

At this point, I could send someone over to wipe out you and and your robot wife - and all I would get from the cops is a citizen achievement award. You sure have made good friends with them, haven't you bud... Once again, nobody, and I mean nobody, cares about a single thing you have to say. I've made sure of that.

You see Scott, the only reason you aren't in intensive care, at the very least, is because you are a crazy douche bag that isn't worth the energy or political capital it would take to get rid of you. If you weren't crazy, and actually threatened my existence in the least bit, you would be dead already... Understand?

These emails are the most disturbing emails of dozens of other disturbing emails sent by Mr. Nelson to the Huminskis, some eluding to organized crime-type activities.  They are completely in context with scores of other threatening emails from Mr. Nelson.  Amazingly, the Phoenix Police are considering a prosecution of the Huminskis for forwarding the above three emails to Urgent Psychiatric Care of Phoenix.  Something is deeply wrong with this after the Gabby Giffords tragedy.  Criminalizing reporting of dangerous mental health issues of persons such as Jared Loughner or Mr. Nelson is a terribly misguided law enforcement policy.  The Phoenix police contact with Scott Huminski investigating the "crime" of reporting the above emails to State psychiatric authorities invites non-reporting and more Tucson-style terror.

Federal Legislation

In light of an absence of effective State law to handle such issues and/or the refusal of State law enforcement to address such matters, Federal Legislation is required to regulate this interstate use of the internet for terror and hopefully prevent another Gabby Giffords type incident.

The most disturbing part of this incident was the outright refusal of law enforcement to pick up Mr. Nelson for mental evaluation when ordered by a licensed mental health facility as a result of transmittal of interstate threats.  This law enforcement conduct should be a federal crime as it invites violence and murder.  There was much talk of the ability to evaluate Jared Loughner prior to the shootings.  This would have been futile as Arizona law enforcement obstructs such pickups as a policy, if someone did report Loughner, it would have been useless with law enforcement's outright refusal to execute mental evaluation pickups.

There should also be consideration of legislation setting parameters making it criminal for state law enforcement to ignore such interstate communications and make it mandatory for State law enforcement to report such terror-style internet communications to federal authorities for review and prosecution.  In this age of heighten security, the last thing needed is law enforcement's willing promotion or cover-up of the terrorist-style above threats by inaction.  Arizona law enforcement has not learned from the Tucson tragedy.  Proactive rather than reactive is the proper response to death and violence emails.

Arizona Invites More Gabby Giffords Style Murder/Violence

I have published this issue on the internet under the above title which explains the severity of the issue in a direct manner. See:

My family lives in constant fear as mental health professionals have found the emails indicative of mental disease and we have been forced to obtain many pepper spray devices, weapons and we hang construction lighting outside our windows to increase our security.  This is AZ law enforcement post-Tucson shootings and murders.  Sheriff Arpaio is deeply involved in this matter, an issue for another day.

                                                            Sincerely,

                                                            /s/ Scott Huminski
